1. Definitions

In these terms of use:

• Content means all content (including data, text, video, images, audio and other material) that is accessible to you and other users on platypusSPOT (but excludes any content that is accessible from websites that are not cesar websites, such as via hyperlinks from platypusSPOT).
• Contributions means content that is contributed by you and other users to platypusSPOT, such as platypus sightings submissions and comments on others’ sightings.  cesar may (in its absolute discretion) make such content generally accessible via platypusSPOT.

2. Your use of the platypusSPOT

cesar grants you a non-exclusive and non-transferable right to access platypusSPOT and, subject to these terms of use, to:
(a) submit Contributions to cesar; and
(b) view, retrieve and display Contributions (and other Content).

3. Submitting Contributions

3.1 cesar may permit you to submit Contributions which you (and not cesar) are solely responsible for ensuring accuracy.
3.2 You acknowledge that cesar:
(a) retains the absolute discretion to determine whether Contributions should be made accessible via the platypusSPOT (and without limitation, cesar is under no obligation to give reasons for its decision that a Contribution will not be made accessible via the platypusSPOT); and  
(b) may at any time, in its absolute discretion, and without liability to you:
(i) edit any Contribution and make that edited version accessible on platypusSPOT; and
(ii) remove, alter or disable access to any Contribution or platypusSPOT generally (whether temporarily or permanently) without prior notice to you.

4. Browsing Contributions

You acknowledge that, when browsing or accessing platypusSPOT, you may be exposed to the Contributions of other users.  cesar is not responsible for, and disclaims all liability relating to, the Contributions of other users.  You release cesar from any claims that you could assert against cesar relating to the Contributions of other users.

5. Other warranties given by you

You warrant that:

(a) all information you supply in connection with your Contribution (including your name and email address) is accurate in all respects;
(b) your use of the platypusSPOT will comply at all times with these terms of use and any directions published from time to time by cesar on platypusSPOT; and
(c) you will not submit any Contributions that:
(i)   infringe the intellectual property or other rights of any other person;
(ii)  are misleading or deceptive;
(iii) are defamatory;
(iv) are obscene;
(v)  are unlawful or encourage unlawful conduct; or
(vi) are inappropriate having regard to the purpose and objectives of platypusSPOT.

6. Respecting your privacy and the law

The privacy of your personal information is important to us at cesar Pty Ltd (cesar). We are committed to respecting your right to privacy and protecting your personal information. Any personal information collected, handled, stored or disclosed about you through platypusSPOT will be managed in accordance to this Privacy Policy, the National Privacy Principles in the Privacy Act 1988 (Cth) and any other applicable laws and codes affecting your personal information.

cesar is and attempts to be sensitive to your privacy on the Internet. Whenever possible, cesar will attempt to treat the information we receive about you on or via the Internet with care deemed reasonable under the circumstances. cesar may use information provided by you (if any), or obtained by you using platypusSPOT to measure the use of this website and to improve the content.

If you are making a Contribution to platypusSPOT we will collect and hold your personal information for the purposes of managing and administering your Contribution to platypusSPOT.

• other information cesar reasonably considers necessary.

In general terms, you are under no obligation to provide any information that we may request of you. You should however be aware that by withholding requested information, we may be unable to maintain your Contribution to platypusSPOT.
